These Terms & Conditions ("Terms") govern your use of shippingwish.com and the operations services provided by Shipping Wish LLC ("Shipping Wish," "we," "us," or "our"). By using our website or services, you agree to these Terms.

1. Our Services

Shipping Wish LLC provides fleet operations support, including load sourcing, rate negotiation, route planning, and paperwork support, to owner-operators and motor carriers. We act as an independent operations manager on behalf of our clients; we are not a motor carrier and do not transport freight ourselves.

2. Client Responsibilities

• Clients must hold valid operating authority, insurance, and licensing required to legally transport freight, where applicable.
• Clients are responsible for the safe and lawful operation of their vehicles and compliance with all DOT/FMCSA regulations.
• Clients must provide accurate information about their equipment, availability, and documentation.

3. Fees

Service is billed as a weekly Stripe subscription after a 7-day free trial unless a separate written agreement says otherwise. You keep freight pay from brokers or factors. Canceling the subscription in Stripe before the first charge means you owe $0 for that trial. Fee amounts are shown at checkout and may vary by fleet size.

4. No Guarantee of Loads or Rates

While we work to secure consistent freight, Shipping Wish LLC does not guarantee a specific volume of loads, rates, or delivery timelines.

5. Account Registration

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

6. Limitation of Liability

To the fullest extent permitted by law, Shipping Wish LLC is not liable for indirect, incidental, or consequential damages arising from the use of our services, except as otherwise required by applicable law or a separate written agreement.

7. Termination

Either party may end the relationship at any time with reasonable notice.

8. Governing Law

These Terms are governed by the laws of the State of Delaware and the United States.

9. Changes

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.

10. SMS Program (Text Messaging)

By providing your mobile number and consenting to receive texts — through our website forms, by replying YES to an outreach message, or as an active client — you agree to receive operational SMS from Shipping Wish LLC under these terms:

• Program name: Shipping Wish Operations SMS.
• Purpose: Fleet operations updates, onboarding, load status, billing reminders, and dispatcher communications. Messages are not promotional spam; they relate to services you requested or operational accounts.
• Sender: Texts are sent from +1 (609) 469-6004. Voice calls may be handled at +1 (917) 737-0021.
• Frequency: Message frequency varies. You may receive several messages during active freight or onboarding, and fewer when idle.
• Charges: Message and data rates may apply. Check with your wireless carrier.
• Opt-out: Reply STOP to cancel SMS at any time. Reply HELP for help. After STOP, you may still receive a one-time confirmation. Opting out of SMS does not cancel your weekly subscription — cancel billing separately in Stripe.
• Consent not required to buy: Consent to receive SMS is not a condition of purchasing our weekly operations plan, except where you choose to receive account alerts by text.
• Supported carriers: Delivery depends on your mobile carrier. We are not responsible for delayed or undelivered messages caused by carriers or device issues.
